Competition Terms and Conditions
1. Entry
1.1 Entry is open to Gaydar members and guests aged 18 years or over. Employees and their immediate families (including any live-in partner) of the Promoter (see the end of these Terms and Conditions below for details), QSoft Consulting Limited (if different) and/or agencies associated with this competition are ineligible to enter. Any such entries will be invalid.
1.2 The opening date and time for the competition is 26th September 2011 at 8am GMT and the closing date is the end of Monday 17th October 2011 GMT. Any entries received before or after these times will be discounted. To enter, entrants are required to send one online message from their gaydar profile to the gaydarpassport gaydar profile and state in the online message:
o) full name
o) contact email address and phone number
o) the name of the last city visited on the Out Adventures Costa Rica Trip: http://www.out-adventures.com/trip/lesbian-and-gay-costa-rica-588/
1.3 Entry to the competition is via www.gaydar.co.uk or associated URL
1.4 Only one message to be sent per member/guest. Additional messages sent will be invalid.
1.5 There is no charge for entering the competition.
2. The Prize
2.1 The first entry drawn at random from all eligible entries will win the prize provided that they have supplied all of the information specified in 1.2 above. The winner will be contacted via email through the address they provided upon entry, after the closing of the competition. If they cannot be contacted, do not respond as specified within 2 days of having been contacted, or are unable to redeem the prize for any reason, then the Promoter reserves the right to offer the Prize to the next entrant drawn and thereafter until a winner is found.
2.2 The prize is a Trip for 2 to Costa Rica with Out Adventures , 9 days comfort Costa Rica itinerary, accommodation for 8 nights, arrival transfer (San Jose), meals and activities indicated in the itinerary – please see http://www.out-adventures.com/trip/lesbian-and-gay-costa-rica-588/ . Travel for the winners to/from San Jose will also be subsidised up to a maximum of £1000 in total, on submission of valid receipt for cheapest economy class fare available – and only for travel on dates that are obviously related to redeeming this prize. Prize does not include transfer to the departing airport or home on return from Costa Rica.
2.2.2 The date of the trip is 27th December 2011 for 8 nights and is not changeable.
2.3 No cash equivalent or alternative prize will be given and the prize is non-transferable. However, the Promoter reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.
2.4 In the event that the winner does not, or is unable to, comply with and meet these Terms and Conditions, the Promoter shall be entitled at its discretion to disqualify the winner, without any further liability to the winner.
2.5 The winner of the contest will hereby agree to have their photo taken and be interviewed by either a staff member or an individual acting on behalf of Qsoft Consulting. Qsoft Consulting will have the absolute right and to permission to use, re-use, publish, re-publish, exhibit, display, print and reprint in advertising material, including motion pictures, magazines, book form and other media including the internet and all electronic media for any purpose.
3. Data Protection
3.1 The Promoter (or any third party nominated by the Promoter) may use the winner’s name [and image] and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid. However, save as set out in this clause, information and data (“personal data”) which is provided by you as an entrant when you enter will be held and used by the Promoter, QSoft Consulting Limited (if different) and their suppliers and contractors in order to administer the competition. Entrants personal data may also be passed to their cellular phone provider (where the phone entry channel is used) or to relevant regulatory bodies, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity or where requested by the phone provider in connection with the billing arrangements for the competition. Aggregate, non personal data may also be used for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services.
3.2 Your personal data will only otherwise be used by QSoft Consulting Limited in accordance with its privacy policy and by the Promoter in relation to its (where different). QSoft’s privacy policy can be viewed at http://gaydar.co.uk/scripts/privacy.asp.
4. General Terms
4.1 The Promoter and QSoft Consulting Limited (if different) are not responsible for network, telephone line or communication failures of any kind or for entries that are incomplete or incomprehensible or not received. Such entries will be void.
4.2 The Promoter reserves the right to verify the eligibility of entrants and check their identity.
Entries that are incorrect, incomplete or inaudible will be void. No refund will be made for the cost of any entry. In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the competition or the operation of the phone system, the decision of the Promoter shall be final. The Promoter and QSoft Consulting Limited (if different) can make no guarantee of telephone access to the competition.
4.3 The Promoter and QSoft Consulting Limited (if different) are not responsible for network, telephone line or communication failures of any kind or for entries that are incomplete or incomprehensible or not received. Such entries will be void.
4.4 Nothing in these Terms and Conditions shall exclude or limit the Promoter’s or QSoft Consulting Limited’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
4.5 These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of England unless you as an entrant are a Scottish resident in which case you may choose the law of your residence and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales again unless you are a Scottish resident in which case you may choose the courts of your residence in Scotland.
4.6 Please note that calls may be recorded to ensure that competition entries are captured, for staff training and quality control purposes.
